General

The following General Terms and Conditions are valid for all orders at Peroti Leather Products. Alternative agreement becomes a component of the contract only in case of being formally confirmed by written by the seller. The seller’s offers are non-binding as such an online catalogue. A contract only comes off by written confirmation (by e-mail) of your online-order.

Delivery and Prices

Basically delivery takes place at the price agreed and valid on the day of placing the order and after receipt of the payment of the purchasing price inclusive of VAT. Delivery charges are calculated as per following description. The consideration of an individual special request within your order or the production to measure will be surcharged. Please ask for the prices of the production to measure.

The indicated delivery dates are estimated on the basis of existent experience and can vary due to the production in manual work. As a general rule, delivery time is between 6 and 8 weeks, because each pair of shoes is a single-item production. Exact dates will not be fixed.
Should the pair of shoes be a standard modal at a standard size and being available, delivery will take place accordingly. We will inform you about the estimated time of delivery. Should the shoes not be available and could not be supplied by the seller within a corresponding period, the seller reserves his right to terminate the contract.

Return of goods

In case of return of goods freight forward, we refuse acceptance. Please make absolutely sure to frank the parcel properly. For delivery by courier and other irregular delivery methods, we will not bear any costs exceeding the costs of delivery by the post.

Payment and Reservation of proprietary rights
We deliver only on advance payment, e.g. after receipt of the purchase price on our account…, the goods will be delivered.

Up to the pending payment in full, the goods are propriety of Peroti Leather Products. In case of delayed payment, we are entitled to terminate the contract.

Right of rescission

You can cancel your formal contract within 2 weeks after order (e.g. by mail, fax, e-mail) without any specification of reasons. The cancellation must be dispatched on time to maintain the cancellation period. The cancellation must be addressed to:…

The right of rescission does not exist for goods being produced on the client’s specification or clearly custom-designed (produced to measure) or not being adapted for return due to their consistency.

Deficiencies and Right of Return

The goods must be examined on receipt. Obvious deficiencies must be immediately indicated to the seller, 8 days at the latest after the receipt of goods. In case of justified reclamation, we reserve the right of rework or replacement to our choice. Little colour deviations of different batches on leather goods, shoe materials or accessories in handwork are not avoidable and therefore not subject to any deficiency. Accordingly, the same is valid for detail changes of products representing no essential features. Dancing / Dress shoes, Bags and Belts are articles of daily use and can show wear marks or can be consumed also within the warranty period. Cancellation consequences

In case of an effective cancellation, the accomplishments must be given back on both sides. Couldn’t you give us back the received accomplishment wholly or partially or only in degraded condition or with signs of usage, you must insofar afford compensation where appropriate. This is not valid for the allocation of property if the degradation of the goods
is traceable exclusively to their check/ trying on, as such having been possible in a shop. You can avoid the obligatory compensation by not taking them into general use like a proprietor and omit every negative impact on the value. This means that we only take back dancing shoes that were only tried on, especially without any signs of use of the sole. Therefore we highly recommend trying them on a carpet floor.
For Bags and Belt we don't take them back if they are used.

Liability

The seller is only liable for intent and act of gross negligence. The liability for indirect and consequential damage is excluded. The liability is restricted to each value of goods concerned. The liability for delivery dates as well as the right to damages for delay in delivery is
expressively excluded.

Protection of Privacy

We save and use your data for administration purposes, the execution of the order/contract and for marketing purposes. For your orders and the execution we do need your address and communication data. Moreover we save your open and executed orders in a customer data file. Furthermore we do not use your data in terms of legal requirements and neither we pass them to a third party.

Final clauses

For legal transactions or other legal relations with Peroti Leather Products the law of the German Federal Republic is valid. The place of jurisdiction for all civil disputes resulting from the contract is Düsseldorf. In case of ineffectiveness of individual conditions of the delivery contract or the present General Terms and Conditions, all the rest of the conditions keep being active.
